CANCELLATION CHARGES AGREEMENT

HOTEL RESERVATIONS

ARTICLE 1 - DEFINITIONS

The Company: L’EUROPÉENNE D’ASSURANCES VOYAGES

Insured person: Any natural or legal person who has made a reservation for one or more nights in a hotel via the Availpro hotel booking system.

Illness: An alteration to a person's health, duly diagnosed by a medical doctor necessitating medical treatment and which occurs suddenly and unforeseeably.

Accident: A sudden, accidental event occurring to a natural person, not intentionally caused by the victim, and arising from the sudden action of an external cause and which prevents the victim from moving about unaided.

Family: Spouse or common law partner, an ascendant or descendant up to 2 degrees of relationship, father-in-law, mother-in-law, brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law, or any person who usually lives with the insured person.

Excess : Share in the compensation payable by yourself.

Domicile/Home: The Insured person's domicile is considered to be their principal and usual place of residence, which appears on their income tax declaration.

Event: Any act that generates damaging consequences, that is liable to result in the operation of one or more types of cover under this policy.

Random event: A random event is understood to be any circumstance that is outside of the insured person's control or the control of a member of their family and which is unforeseeable on the day of the booking and arises from the sudden action of an external cause.

ARTICLE 2 - NATURE OF THE COVER

L'Européenne d'Assurances Voyages will refund the deposits and any sums retained by the hotel and charged by it in accordance with its General Terms and Conditions of Sale, if the reservation cancellation, made after the insurance policy was taken out, results from the occurrence of one of the following events:

  • Death of the insured person or a member of his/her family,
  • Illness or accident preventing the trip,
  • Random event,

A random event is understood to be any circumstance that is outside of the insured person's control or the control of a member of their family and which is unforeseeable at the date when the policy was taken out and which arises from the sudden action of an external cause.

ARTICLE 3 - EFFECTIVE PERIOD OF THE COVER

Subject to the insured person having previously paid the corresponding premium and having taken out this policy on the day of the booking, cover takes effect from the date when this policy is taken out and expires at the time when the keys are handed back to the hotel.

No-Show by the Insured person is not covered if it does not result from a covered event.

ARTICLE 4 - LIMIT TO THE COVER

Compensation due by virtue of this cover can not exceed the actual amount of penalties charged up to a maximum of €750 per reservation and €2,500 for the same event.

Administration fees, the insurance premium, airport taxes and visa costs are not refundable.

ARTICLE 5 - EXCESS

No excess will be applied.

ARTICLE 6 - EXCLUSIONS

In addition to the exclusions contained in the General Terms and Conditions, cancellation arising from the following is not covered :

  • The death of a relation, if this occurs over fifteen days prior to the departure date,
  • An illness or accident which the insured person had knowledge of before the reservation was made,
  • Beauty treatment, spa treatment, voluntary termination of pregnancy, in vitro fertilisation and its consequences, artificial insemination and its consequences, pregnancy, a complication in pregnancy and its consequences
  • Visa refusal for a passport irregularity,
  • A psychological or mental illness or depression not requiring hospitalisation or resulting in a hospital stay of less than 3 days,
  • Any circumstance that only harms the simple pleasure of the insured person's trip,
  • By the simple fact that the government representative, of the insured person's country of residence, has advised against the travel destination.
  • A late visa application to the competent authorities, refusal of a visa, passport irregularity, failure to get vaccinated.

ARTICLE 7 - OBLIGATIONS IN THE EVENT OF A CLAIM

  • The Insured person or his/her beneficiaries must :
  • When the claim event occurs, notify the hotel for which the reservation has been made. If the insured person is late in making the cancellation L'Européenne d'Assurances can only be held responsible for the cancellation fees chargeable at the date on which the event occurred.
  • At all times, the Company reserves the right to check the validity of the claim by requiring the insured person to produce documents in support of the amount paid and the reason for the cancellation.
